[ARCHIVED] Arrest Made Following Shots Fired

On September 22nd, 2015 at approximately 12:52 p.m., Dubuque Police responded to the area of 18th and Jackson on a report of shots fired in the area.

Witnesses at the scene advised two males fired shots at one another. Surveillance and traffic camera footage in the area was reviewed by police and confirmed the witness accounts. The ensuing investigation identified one of the shooters as Martin Lewis Smith, 20 (no permanent/confirmed address). No injuries were reported or know to have resulted from the shooting, but at least one building in the area sustained damage consistent with a bullet impact that could be related to this incident.

Smith was arrested and charged with Going Armed with Intent, a Class D Felony punishable by up to 5 years in prison and a fine between seven hundred fifty dollars and seven thousand five hundred dollars. Smith is being held in the Dubuque County Jail pending an initial court appearance on Wednesday, September 23rd. The investigation remains active.

As with any criminal case, the charges filed are allegations and any suspects are presumed innocent until convicted in a court of law.
