On December 12th, 2013 at 2:03 a.m. Dubuque Police responded to a burglary in progress at 695 Roberts Street. Upon arrival, officers located evidence of forced entry and tracks in the snow indicating the suspect fled.
On December 12th, 2013 at 2:03 a.m. Dubuque Police responded to a burglary in progress at 695 Roberts Street. Upon arrival, officers located evidence of forced entry and tracks in the snow indicating the suspect fled. The investigation led officers to the 700 block of Alta Vista Street where they were approached by a resident who said there was an unwelcome person in the basement of his residence. Officers, including the DPD K9 Unit, surrounded the residence. The K9 handler issued multiple warnings to surrender from the top of the basement stairs but the suspect failed to respond. When it was evident the suspect would not surrender willingly, the K9 was deployed into the basement where Justin E. Klauer, 31, of 1483 Old Mill Road, Dubuque, was immediately apprehended. Klauer was transported to Mercy Hospital by Dubuque Fire/EMS where he was treated for minor wounds and released back to police.
Klauer remains in the Dubuque County Jail on a $20,000 cash bond. He is charged with Burglary 2nd Degree, Attempted Burglary 3rd Degree, Possession of Burglar Tools, and Trespass. Burglary 2nd Degree is a Class C Felony punishable by up to 10 years in prison and a fine between $1,000 and $10,000. Possession of Burglar Tools is an Aggravated Misdemeanor punishable by up to 2 years in prison and a fine between $625 and $6,250. Attempted Burglary 3rd Degree is a Serious Misdemeanor punishable by up to 1 year incarceration and a fine between $315 and $1,875. Lastly, Trespass is a Simple Misdemeanor punishable by up to 30 days in jail and a fine between $65 and $625.
As with any criminal case, the charges filed are allegations and any suspects are presumed innocent until convicted in a court of law.
