On September 17th, 2013, Dubuque Police and Dubuque Community School District (DCSD) personnel received a report of an airsoft gun assault on a school bus carrying Roosevelt Middle School and Hempstead High School students. The incident occurred the previous morning (September 16th) and involved a 13 year old student who discharged the weapon at least twice, striking two students on the bus. One student was uninjured and the other suffered a minor injury that did not require medical treatment. Asbury Police are also investigating a separate incident that happened later the same afternoon in their jurisdiction, also involving the 13 year old suspect referenced above.

Based on the investigation conducted by the DPD and DCSD, the 13 year old suspect will be charged as a juvenile with 1 count of Assault Causing Injury (Serious Misdemeanor), and 1 count of Simple Assault (Simple Misdemeanor).

As indicated in the DCSD statement released earlier this afternoon, students & parents/guardians are again reminded that airsoft guns, as with any weapon, are strictly prohibited on DCSD property. Students choosing to violate the law & school policy pertaining to weapons should expect swift, certain, and severe consequences including, but not limited to, criminal charges.

As with any criminal case, the charges filed are allegations and any suspects are presumed innocent until convicted in a court of law.
