[ARCHIVED] Dubuque Students Charged With Weapon Violation

On September 12th, 2013, at 10:57 a.m., a Dubuque Police School Resource Officer and officials with the Dubuque Community School District located an airsoft pistol in the backpack of a Washington Junior High student.

On September 12th, 2013, at 10:57 a.m., a Dubuque Police School Resource Officer and officials with the Dubuque Community School District located an airsoft pistol in the backpack of a Washington Junior High student. An airsoft pistol is a non-lethal weapon that launches plastic or rubber projectiles using a spring or compressed air mechanism. Based on the investigation, officials believe there was no immediate threat to other students or school staff, but ordered a lockdown as a precautionary measure. As an additional precautionary measure, the Dubuque Police Department’s Explosives Detection K9 Unit conducted a search of the school to ensure there was no presence of gunpowder and/or ammunition on premises. The results of this search were negative. However, based on information learned during the preliminary investigation, 3 air/bb pistols were located among the belongings of 2 other students.

The 3 students involved (2 thirteen year olds and 1 fourteen year old) were charged as juveniles with violating City Code Ordinance 7-5A-10 which prohibits carrying concealed weapons, to include air guns, without a permit. The charge is a simple misdemeanor and all 3 were released to their guardians pending initial court proceedings.

As with any criminal case, the charges filed are allegations and any suspects are presumed innocent until convicted in a court of law.
