On Thursday, May 16th, 2013, at 3:26 p.m., Dubuque Police responded to the area of 24th and White Streets on the report of “shots fired”. Based on information obtained during the initial phase of the investigation, officers formed a parameter around 2410 White Street and established phone contact inside. Four occupants exited voluntarily, including Christopher C. Barginear, 02/23/84, of 765 Alpine Street, Dubuque. As part of the investigation, interviews were conducted with these subjects and a search warrant was also executed at the residence.

The shooting allegedly occurred in the area of 24th and Jackson Streets, where Barginear and some of his associates had an altercation with a subject identified as Walton E. Womack, 37, of Dubuque. During the altercation, Barginear is believed to have discharged a handgun. Evidence supporting said discharge was located in the area but there were no reported injuries or damage.

Barginear was arrested and charged with Assault While Participating in a Felony, Going Armed with Intent, and Possession of a Firearm by a Felon – all Class D Felonies, each punishable by a fine between $750 and $7,500 and up to 5 years in prison. He is being held in the Dubuque County Jail on a $50,000 cash bond.

As with any criminal case, the charges filed are allegations and any suspect(s) charged are presumed innocent until convicted in a court of law.
