On July 21st, 2012 an 11 year old girl reported she was approached at approximately 2:00 p.m. by a male in a van near 27th & Jackson Streets. According to the girl, the male exited the van, approached her and attempted to engage her in conversation.

On July 21st, 2012 an 11 year old girl reported she was approached at approximately 2:00 p.m. by a male in a van near 27th & Jackson Streets. According to the girl, the male exited the van, approached her and attempted to engage her in conversation. She believed he also made a gesture toward her face. The girl then fled and had no further contact with the male.

Dubuque Police initiated an investigation and based on information provided by the public and assistance from the Dubuque County Sheriff’s Office, today were able to locate and identify the male involved. He voluntarily agreed to be interviewed at the Dubuque Law Enforcement Center and admitted to talking to the girl. It was also during interviews with the male and other witnesses that investigators learned the incident actually happened in the 2500 block of White Street instead of 27th & Jackson Streets. Additionally, interviews revealed a lack of criminal intent on the male’s behalf and additional factors that contributed to miscommunication and confusion during the incident.

Based on the investigation, totality of circumstances, and consultation with the Dubuque County Attorney’s Office, no criminal charges will be filed in this investigation. Probable cause is not sufficient, and the elements required by Iowa Code are not satisfied. The investigation also confirmed some information circulated via social media and other venues was inaccurate; however citizens are still encouraged to discuss personal safety with their children and immediately report any suspicious/criminal activity to authorities.
