[ARCHIVED] Second Arrest Made in Shooting Investigation

On September 27th, at approximately 2:00 a.m., Dubuque Police arrested a second suspect believed to have been involved in the exchange of gunfire on September 22nd, 2015, in Dubuque.

The suspect identified himself as Javon Johnson, 18, of 2512 Elm Street, Dubuque. Johnson was arrested as part of an unrelated investigation initiated on the 26th that led to him being charged with violating the city ordinance prohibiting persons under 21 years of age from being in a bar/tavern past 9:00 p.m. During contact with Johnson on the 26th/27th, enough probable cause was established to charge him with Going Armed with Intent for his alleged involvement in the aforementioned shooting. It is believed the shooting was the result of a feud over a female mutually known to the men involved.

As part of the ongoing investigation, the first male subject arrested on September 22nd, Martin L. Smith, 20, has also been charged with Possession of a Firearm as a Felon, Assault While Displaying a Dangerous Weapon, Harassment 1st Degree & Reckless Use of a Firearm. These new charges are in addition to the original charge of Going Armed with Intent. Both men remain incarcerated in the Dubuque County Jail. Going Armed with Intent and Possession of a Firearm by a Felon are both Class D Felonies, punishable by a fine between $750 and $7,500 and imprisonment up to 5 years. Assault While Displaying a Dangerous Weapon, Harassment 1st Degree and Reckless Use of a Firearm are all Aggravated Misdemeanors punishable by a fine between $626 and $6,250, and imprisonment up to 2 years. Additional charges remain a possibility as the investigation progresses.

As with any criminal case, the charges filed are allegations and any suspects are presumed innocent until convicted in a court of law.
